TRAFFICKING IN MARIJUANA/GROW HOUSE CASE DISMISSED

Lehigh Acres

A woman living in a home where marijuana plants were being cultivated by the husband was arrested because law enforcement believed that she had knowledge of the operation and she was a resident of the home.

After she was bonded out by family members she came to me for help. I reviewed the case and requested information from her regarding the location of where the plants were located in the home, who else lived in the home, and what if any statements were made to law enforcement. Upon further review of the facts in the case it was determined that there was no way the client/wife could have known what the husband was doing. Case never made it to arraignment.

Habitual Traffic Offender walks.

Lee County

Client was arrested on August 4, 2009 for Habitual Traffic Offender – Driving While License Suspended or Revoked. She had been previously arrested on four prior occasions and certainly looking at incarceration of up to five years in prison.

After reviewing the facts in the case it was ascertained the reason for the stop although valid on its face was unlawful. In a pre-file meeting with the assigned prosecutor to the case it was agreed to dismiss client’s case instead of having a potentially embarrassing motion to suppress the stop of client’s vehicle.

DUI DISMISSED

Lee County

A blue collar working man was pulled over at a DUI checkpoint. After being asked to step out of his vehicle, he failed the field sobriety exercises and breath intoxilyzer results were .187 bac. More than two times the legal limit.

After filing a motion to suppress the stop of his car and challenging the constitutionality of the checkpoint the State Attorney’s offered my client to DISMISS the DUI and allow him to plea to a reckless driving.

AGGRAVATED BATTERY WITH A DEADLY WEAPON DISMISSED

Lee County

The defendant in this case, a young man, was charged with striking another man with a tree branch causing pain and bleeding. He was arrested for Aggravated Battery with a deadly weapon, a second degree felony, punishable by up to fifteen years in prison.

After his family hired my firm I immediately went to work to investigate the facts and evidence in the case. After weeks of constant intense negotiations and conversations with the State Attorney's Office the young man's case was dismissed.
